Terms and Conditions

Pixnest Technologies Private Limited offers products, software, and services (collectively referred to as “Services”) based on the Client’s (hereafter referred to as “Client”) acceptance of and compliance with these Terms and Conditions (hereinafter referred to as “Terms”) and the Service Level Assurance Agreement (hereinafter referred to as “SLA”) outlined below:

AGREEMENT DURATION

The agreement begins when the Client enrolls in the Services and continues until terminated by either party, following the Terms and SLA outlined herein.

SERVICE DESCRIPTION

Depending on the Client’s selected package, Pixnest Technologies Private Limited may provide a range of services, including but not limited to: business websites, business-related web pages, Search Engine Marketing, Search Engine Optimization, third-party content, storage space, domain-based email services, website hosting, and maintenance & support services. Any new feature that augments or enhances these Services will be considered part of the Services unless stated otherwise.

Pixnest Technologies Private Limited reserves the right to modify, suspend, or discontinue the Services (or any part thereof) with 2 days prior notice, especially in cases of non-cooperation, nonpayment, or unwanted delays. The Client agrees that neither they nor any third party associated with them will hold Pixnest Technologies Private Limited or its suppliers liable for any losses, damages, or consequences resulting from such modifications, suspensions, or discontinuations.

ACCESS TO SERVICES

For purposes of this Agreement, any website owned, operated, or hosted by Pixnest Technologies Private Limited or on behalf of the company will be referred to as the “Pixnest Technologies Private Limited  Websites”.

To access Pixnest Technologies Private Limited’s Services or Websites, the Client may be asked to provide certain registration details. The Client agrees to provide correct, current, and complete information for access. If any information provided by the Client is deemed incorrect or incomplete, Pixnest Technologies Private Limited reserves the right to refuse access or suspend the Client’s account.

PAYMENT TERMS

The Client agrees to pay Pixnest Technologies Private Limited the agreed-upon service fees for any Program or Service they enroll in, in accordance with the Payment Plan chosen, including any applicable taxes. Payments must be made according to the billing terms in effect when the service fee is due.

The Client authorizes Pixnest Technologies Private Limited to automatically charge their credit card or bank account monthly or as a one-time charge, depending on the Program requirements.

Upon signing up, the Client will be charged immediately. If payments are not made as required,

Pixnest Technologies Private Limited reserves the right to pursue alternative collection methods, including debt collection services, with the Client responsible for all collection-related costs, including attorneys’ fees. If there is no response  from the Client within 7 days, Pixnest Technologies Private Limited may charge the outstanding amount, and such amounts will not be refunded.

CANCELLATION AND REFUND POLICY

All amounts owed for Services provided prior to the verified cancellation date must be paid in full. There will be no prorated refunds for partial months during the term of the Agreement.

Cancellation requests must be made in writing or via email for security and privacy reasons. Requests will only be processed if received by the party initially authorizing the Agreement. Cancellations made after the cooling-off period (7 days from the date of signup) are non-refundable.

Any cancellations after the cooling-off period will require full payment of the agreed amount and immediate termination of the contract.

PAYMENT COLLECTION POLICY

Given the significant credit risk Pixnest Technologies Private Limited takes on with each Client, the Client must ensure an active and valid payment method is always on file.

If the Client’s payment method becomes invalid, Pixnest Technologies Private Limited reserves the right to suspend the website, pay-per-click ads, sponsored listings, and any ongoing services until payment is received.

Failure to make payment will result in Pixnest Technologies Private Limited terminating the Agreement and retaining ownership of the website, domain name, and any other Services until the account balance is cleared.

CLIENT REPRESENTATIONS AND WARRANTIES

The Client warrants that:

• They have sufficient authority to enter into this Agreement.
• The Client’s use of Pixnest Technologies Private Limited’s Services is solely for lawful commercial and business purposes.
• They have the necessary rights to provide all information used in connection with the Services and that such information does not infringe upon any third-party rights, including but not limited to copyrights, trademarks, or privacy rights.
• The information provided will not result in any legal violations or harm, including but not limited to fraud, injury, damage, or harm to any third party.
• All information provided is accurate and complies with applicable laws, including anti-spam regulations like the CAN-SPAM Act of 2003.

INDEMNIFICATION

The Client agrees to indentify and hold Pixnest Technologies Private Limited, its subsidiaries, affiliates, content providers, employees, and contractors harmless from any claims arising from their breach of these Terms or any unauthorized use of the services, including but not limited to damages or legal fees incurred by Pixnest Technologies Private Limited.

TRADEMARKS

All trademarks, service marks, and logos appearing on this site are the property of Pixnest

Technologies Private Limited or the party that provided them. The Client acknowledges that Pixnest Technologies Private Limited and its licensors retain all rights to their respective trademarks, service marks, and logos.
